9/24/1999 This case related to premises Liability, Negligence and Personal Injury and the use of  Automatic Doors. Eugene Peak, then age 64, was injured on December 13, 1995, in the defendant Kmart's store in Cullman, by an automatic door. The door had been manufactured by Gyrotech, Inc., and installed by Universal Door Systems, Inc. ("Universal"). The accident occurred as Peak was attempting to enter the store to shop for Christmas gifts. Because he had not fully recovered from a stroke he had suffered the previous summer, he was walking slowly and with the aid of a walking cane. As he approached the building, the outermost set of automatic doors opened and he walked through the doorway. He then encountered a second set of automatic doors, which also opened spontaneously.
12/4/1998 This case related to personal Injury and dog bites.  The Plaintiff was bitten by defendants' pet pit bull dog. The plaintiff visited the defendants frequently and had been told he was "welcome anytime," so he claimed he had the status of a licensee at the time of the dog bite rather than a trespasser even though he did not have specific permission on the specific occasion of the dog bite to be on the property. The dog had bitten the plaintiff on the leg as he got off of his bike that he had ridden onto the property. Plaintiff had to undergo surgery on the wound but no permanent injury was done other than scarring. Defendants claimed that plaintiff was a trespasser and therefore only had a duty not to willfully or wantonly injure him.
